1.0 CONDITIONS OF SALE

The present Contract General Conditions, will expressly regulate the relations between PARADISE DESIGN, S.L.U., with registered office in Spain, Avenida Central 8, 1º dcha, 22330 Aínsa (Huesca), and CIF ES B22366124 (from now on, "PARADISE DESIGN") and third parties ("users", from now on) who register as users and/or buy products through the website online store (http://www.moomdiamond.com) , the "Shop" from now on.

 

1.1 PRODUCTS & PRICES

 

PARADISE DESIGN, S.L.U. reserves the right to decide, at any time, the Products offered to users through the Shop.

PARADISE DESIGN, S.L.U. may add, at any time, new products offered or included in the shop. This will mean that, unless other specification is provided, such new products will be ruled by these current General Conditions, of use and sale. Also, PARADISE DESIGN, S.L.U. reserves the right to stop providing or granting access to and use of any of the different types of products offered in the Store, at any time and without notice.

The products in the store shall match the Products offered indeed, in color and texture or other nuances, in the most reliable and possible way according the web viewing technology. Remember that you can always look up the essential features and prices of products offered in the Store, www.moomdiamond.com within each product record.

The prices shown in the Shop are in Euros and include VAT, unless other information is specified and are valid except misprint.

Prices of products may be subject to updates. Please make sure what the final selling price is before submitting the proper order form.

Unfortunately we can not inform in advance of future offers and/or discounts on prices, or refund the difference once the order has been placed.

Please note that shipping charges are not included in the price of the product displayed in the item record.

Shipping prices will be listed separately while you check out. In case your order would be able to enjoy any eventual "free shipping" offer, you will be advised during the buying process.

 

PARADISE DESIGN reserves the right to modify the commercial offer which is presented on the website as indicated above (changes on products, prices, special offers and other conditions of service) at any time.

 

PARADISE DESIGN does its best, within its means, to provide the information contained on the site in a truthful way and without misprints. In case that at any moment a mistake of this type, out of control of PARADISE DESIGN, occurs, and once it is detected, the company would proceed to its immediate correction. If there is a typographical mistake in any of the prices shown and a User has decided to buy a product according to this mistaken price, PARADISE DESIGN will inform the user of the misprint and the User will be entitled to cancel the purchase with no cost.

 

 

1.2 PLACING AN ORDER

 

PARADISE DESIGN S.L.U. places at the Users’ disposal, on the website www.moomdiamond.com , various products of fashion accessories designed and directly commercialized by PARADISE DESIGN, S.L.U..

The purchase of these products will be accomplished by the user, by filling in different forms that are presented throughout the purchase process.

All orders are subject to acceptance and availability. By placing an order the user (customer) entirely agrees in the acceptance of the commercial proposal of PARADISE DESIGN, S.L.U. and its applicable general conditions.

User also commits him/her to provide PARADISE DESIGN accurate and true data, as well as he/she is an authorized user of the credit card used to place the order and that there is sufficient money to pay the amount of the order.

Once the user has placed an order with PARADISE DESIGN, he/she will receive a confirmation e-mail saying the order has been received and it is being processed. This e-mail will assign a reference code for the purchase and will include the features of the product/s, its/their price/s and shipping cost.

PARADISE DESIGN reserves the right to reject your order in case the requested item is out of stock or does not meet our standard quality controls and has been withdrawn from sale.

When the order is processed, an authorized standard check of the card used to make the payment is performed.

Security controls are carried out in every order. The order will be cancelled in case the order does not pass these tests; if this occurs, the user will be properly informed. 

 

 

1.3 CONFIRMATION OF THE CONTRACT. BILL

 

Once the selling process is ended, PARADISE DESIGN, S.L.U. will provide the User a confirmation of the purchase by sending an e-mail, informing that the order has been accepted and the goods delivered. Within this e-mail, seen as a purchase agreement according to present conditions, will only include the goods listed in the previous confirmation email (the one sent to confirm the shipment, as stated in paragraph 1.3. of these Conditions). This confirmation of the contract set between PARADISE DESIGN, S.L.U. and the user (customer), is guided by the conditions applicable to the product and/or contracted service which are specified on this page.

 

PARADISE DESIGN, S.L.U. will record the electronic documents used to formalize the trade contract, sending a copy to the user once the purchase is made. This contract will be formalized in Spanish.

 

The confirmation of the purchase order sent by PARADISE DESIGN, S.L.U. is not valid as a bill, only as proof of purchase. PARADISE DESIGN, S.L.U. will send the corresponding receipt together with the Product.

 

 

1.4 PAYMENT METHODS

 

The user who buys a product through the online Store must pay through payment methods specified in the Shop, which are: credit card (Visa, MasterCard), bank transfer and PayPal.

The price of the purchase will be charged to the customer's bank account at the moment of shopping, and it will be considered effective when bank centers concerned with the purchase confirm their agreement.

In case that the POS (Point of Sale- Terminal) reports on the denial of the credit or debit card, the order will be automatically cancelled, informing online the user of such situation immediately.

 

 

1.4.1 SECURITY AND PRIVACY

 

PARADISE DESIGN, S.L.U. does not have at its disposal, at any time, your credit card data.

Data are directly entered into a secure website which belongs to the bank that manages the payment, thus ensuring greater security and confidentiality.

 

 

1.5 SHIPPING AND DELIVERY

1.7 SHIPPING AND RETURNS

 

Shipping costs are not included in the price of the product that is displayed in the product record.

To know the shipping cost according to packaging and transportation service, read the following sections here on below.

 

 

1.7.1 SHIPPING TO SPAIN (mainland Spain) 

 

PARADISE DESIGN currently offers only a standard delivery method, according to which you will receive your order within approximately 1 to 3 days, depending on the destination of the parcel. This delivery time is calculated from the very moment when PARADISE DESIGN sends the confirmation order to the user, and the user is notified of the processed order via email

Shipping costs will be displayed on the website at the moment of ordering. Shipping costs are not included in the price of the product shown in the product record.

PARADISE DESIGN delivery Service is carried out in collaboration with renowned logistics operators (MRW, UPS, CORREOS). Orders to PO Boxes, hotels or other non-permanent addresses will not be delivered. 

Our shipping services work from Monday through Friday.

Note that for other circumstances beyond the control of PARADISE DESIGN, e.g. bad weather, transport strikes, etc., processing time may be longer, which might involve the suspension or delay of certain services.

The cost of packaging and shipping services for deliveries within Spain (mainland), is € 6.50 (six euros and fifty cents), that will be added to the total amount of the products at the end of the purchase.

We are pleased to inform that for these orders delivered within Spain (mainland) similar or over € 75.00 (seventy five Euros), shipping costs are free.

 

 

1.7.2 SHIPPING OUTSIDE THE MAINLAND AREA OF SPAIN

 

The delivery time for orders to these destinations can take from 4 to 15 business days depending on delivery location and position in a metropolitan center, urban or remote area.

Shipping costs will be displayed on the website at the time of ordering. Shipping costs are not included in the price of the product shown in the product record.

PARADISE DESIGN delivery Service is carried out in collaboration with renowned logistics operators (MRW, UPS, CORREOS). Orders to PO Boxes, hotels or other non-permanent addresses will not be delivered.

The cost of packaging and shipping services for deliveries to the Balearic Islands, Canary Islands, Ceuta, Melilla, Gibraltar, Andorra and Portugal (excluding Azores and Madeira Islands) is € 8,5 (eight euros and fifty cents), that will be added to the total amount of the products at the end of the purchase.

 

The cost of packaging and shipping services for deliveries to Monaco, Italy, France, Belgium, Holland, Luxembourg, Germany, England, Wales, Scotland, Ireland, Austria, Denmark, R. Ireland, Finland and Sweden will be € 13.00 (thirteen euros). These handling costs will be added to the total amount of the products at the end of the purchase.

 

The cost of packaging and shipping services for deliveries to U.S. and Canada, Madeira Islands, the Azores, Malta,  Cyprus, Bulgaria, Czech Republic, Slovakia, Slovenia, Estonia, Greece, Hungary, Latvia, Lithuania, Poland, Romania, Norway, San Marino, Switzerland and other countries not signed over here will be € 15.00 (five teen euros). In this case pieces are whipped with spanish post in cooperation with your country postal service by certificated air mail priority post. These handling costs will be added to the total amount of the products at the end of the purchase.

 

 

1.8 SIGNATURE AND AKNOWLEDGEMENT RECEIPT

 

All ordered parcels are sealed before being shipped from our Distribution Centre. In no case you shall sign nor accept the delivery of the parcel if the seal tape appeared broken or the packaging was damaged. If it happens, contact our Customer Service as soon as possible by writing to the following address: hola@moomdiamond.com

 

 

1.9 CUSTOM DUTIES AND TAXES

 

Note that all recipients shall be responsible for any IMPORT TAX, CUSTOMS FEES OR DUTY that might arise from the trade operation and any extra expenses.

The customer is responsible for providing all information required by customs to ensure the dispatch of the goods. We recommend that you contact your local customs authority to determine the cost of freight and other import costs before finishing the purchase.

Whenever prices appear in Euros, they correspond to the Recommended Retail Price (RRP) including VAT 21% in case of purchases performed within Spain (mainland).

For dispatches to the Canary Islands, Ceuta, Melilla, Gibraltar, Monaco, Andorra, Suiza, San Marino, Noruega, Canada, EEUU and other countries that are not part of the european economic community, that 21% VAT will be deleted at the time of purchase, although the user shall be responsible for payment of taxes or fees in each particular market. Contact your local tax authorities for further information on this issue.

Sometimes, the delivery of the goods may be delayed because or reasons beyond PARADISE DESIGN control, such as customs delays or adverse weather conditions.

 

 

1.10 DISSATISFACTION, JURISDICTION AND APPLICABLE LAW

 

These general confitions are guided by Spanish law and jurisdiction. Any controversy that may arise concerning the validity, interpretation, compliance or resolution thereof, shall be submitted to the laws and jurisdiction of the Courts of Huesca (Spain), As well, the user shall renounce any other corresponding jurisdiction, in case the applicable laws alow to do so.

It shall be the Spanish version of these General Conditions of Sale which is to be regarded in any case, and this interpretation will be done according to the Spanish Law.

 

 

1.11. RESPONSIBILITY

 

PARADISE DESIGN exempts from any responsibility in case of breach of contract, when this breach results from “force majeure” reasons, total or partial strike of postal services, transport and/or communications especially, flood or fire.

In case of conflict, the customer will address to PARADISE DESIGN, S.L.U. in first place, to attempt an amicable settlement thereof.

 

 

1.12. RETURNS OR EXCHANGES

 

Every sold product may be returned within a period of 14 working days, counting from the date of delivery to the moment when the customer sends the product back to PARADISE DESIGN, S.L.U., in accordance with the provisions of the Spanish Retail Trade Act (Ley de Comercio Minorista). The action of return must be notified via email to the following email address:

You will be asked to fill in a return form that will be provided via email at the very moment you request a refund. In that form, the motivations for change shall be properly stated, such as changing size, or a refund for defective merchandise.

Note that we can only exchange an item for another similar one, but in a different color or size. If you would like another different article, you shall place another order separately, and the former order will be processed accordingly.

The User shall return of the item by using a safe and secured delivery service, given that PARADISE DESIGN, S.L.U. will not be responsible for not received goods. A signature proof will be required to confirm the delivery. We recommend you keep your proof of dispatch until your refund or exchange has been made. The shipping costs of the return parcel will be paid by the user and in no case be the company will accept a COD (collect on delivery), that is to say, a package with unpaid shipping costs.

The refund in the customer's account as a result of such return, shall be processed within 7 working days from the date when PARADISE DESIGN, S.L.U. gets the product back, after verifying that it is in perfect condition. It also will affect the price of the item, as the user is to assume the former shipping costs. In case the customer had taken advantage of any special offer exempting him/her from paying such former shipping costs, the user shall assume as well the shipping costs according the first dispatch.

It is mandatory to return products properly protected, in their original packaging and also in perfect condition (not damaged or soiled by the customer), with all their accessories, labels, documents, the corresponding proof of payment and the return form filled in correctly. These products will be addressed to the location specified by PARADISE DESIGN, S.L.U. in the instructions for returning previously sent via email.

The seller has the right not to accept the return of products without labels and presentation or protecting packages, as well as products that have been damaged, soiled, scratched, or whose essential and qualitative features have been altered.

In case that the return was not accepted by the seller, given that the product is considered to have been used or is in different condition at the time of delivery, the product will remain at the distribution point until the user (customer) places a new order for another similar product - assuming the costs of this new delivery - for a period not exceeding thirty (30) days from the date of return.

Those packages which do not contain any attached item to identify the sender (Order No., name, address ...) will not be returned.

Note that in particular times of the year, such as the Christmas period and on holidays, processing an order may take longer for reasons beyond our control.

Customs fees or taxes on sales are not refundable through PARADISE DESIGN, S.L.U.. Nevertheless, you might get them refunded by contacting directly with your local customs authority.

Everyone who wants to return his/her package will receive an email informing about the amount of your refund, at the email account registered at the moment of the checkout process.

In case the recipient of the goods specified in the order form is different from the one who paid the purchase, the refund of the resulting amounts shall be made by the seller to whom made the payment in first place.
